Beta Terms of Service

These Beta Terms of Service ("Terms") govern your access to and use of the Future Schools beta platform (the "Platform") operated by Future Schools Solutions Ltd ("we", "us", "our").

By creating an account or using the Platform, you agree to be legally bound by these Terms.

1. Beta Nature of the Service and Trial Participation

• The Platform is provided as a limited beta trial for testing, evaluation and feedback purposes only.
• Access is temporary and may be withdrawn at any time.
• Features may change, be modified, suspended or discontinued without notice.
• The Platform is not production-ready and may contain errors.
• Participation in the beta does not create any partnership, joint venture, agency or employment relationship.
• We reserve the right to select, suspend or remove participants at our discretion.

2. Eligibility

The Platform is intended for use by parents or legal guardians aged 18 or over. By using the Platform, you confirm that:

• You are a parent or legal guardian of the child whose information you submit;
• You have full authority to provide that information; and
• All information submitted is accurate to the best of your knowledge.

The Platform is not intended for direct use by children.

3. Account Registration

You must provide accurate and complete information when creating an account and keep your login credentials secure.

You are responsible for all activity under your account.

4. Child Profile Information

You may submit information about your child for the purpose of generating structured profile outputs and school matching insights.

You retain ownership of the information you submit.

You grant us a non-exclusive, worldwide, royalty-free licence to use, host, process and analyse that information for the purposes of operating and improving the Platform during the period your account remains active and thereafter to the extent necessary to comply with legal obligations or resolve disputes.

Following deletion of your account, we may retain and continue to use anonymised and aggregated data derived from submitted information, provided that such data no longer identifies you or your child.

5. Intellectual Property

All intellectual property rights in and to the Platform, including all software, algorithms, models, databases, content, branding, documentation, and all improvements or modifications thereto, are owned exclusively by us or our licensors.

All outputs generated by the Platform (excluding your underlying submitted information) are our intellectual property.

Feedback Assignment

If you provide feedback, suggestions, ideas, enhancement requests or other comments ("Feedback"), you hereby:

• Assign to us all present and future intellectual property rights in that Feedback; and
• Waive any moral rights to the extent permitted by law.

We may use Feedback without restriction or compensation.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose;
• Submit false, misleading, defamatory or infringing content;
• Upload malicious code or attempt to disrupt the Platform;
• Attempt to access other users' accounts or data;
• Copy, scrape, extract, benchmark or commercially exploit any part of the Platform;
• Reverse engineer, decompile or attempt to derive source code;
• Use outputs to create a competing product or service.

We may suspend or terminate access immediately if these Terms are breached.

7. No Reliance and No Professional Advice

The Platform provides informational insights only.

You acknowledge that:

• Outputs are generated using algorithmic analysis;
• They are not guaranteed to be complete or accurate; and
• They do not constitute legal, educational or professional advice.

You are solely responsible for final educational decisions.

8. Confidentiality

As a beta participant, you agree not to disclose or publish any non-public information about the Platform, including features, functionality, performance or documentation, without our prior written consent.

9. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability and non-infringement.

10. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence;
• Fraud or fraudulent misrepresentation; or
• Any liability that cannot be excluded under UK law.

Subject to the above:

• Our total aggregate liability arising out of or in connection with the Platform shall not exceed £100; and
• We shall not be liable for any indirect, consequential, incidental, special or economic loss, including loss of opportunity, reputation, goodwill, data or anticipated savings.

11. Responsibility and Indemnity

Nothing in these Terms limits your statutory rights as a consumer.

You are responsible for your use of the Platform and for ensuring that the information you submit is accurate and lawful.

You agree to indemnify us for losses or claims arising directly from:

• Your breach of these Terms; or
• Your unlawful misuse of the Platform.

This indemnity does not apply to losses caused by our negligence or breach of these Terms.

12. Termination

You may stop using the Platform at any time.

We may suspend or terminate access at any time and for any reason, including the conclusion of the beta programme.

Upon termination, all rights granted to you under these Terms shall cease immediately.

13. Data Protection

We process personal data in accordance with our Privacy Policy, which forms part of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales.

You agree that any disputes shall be brought exclusively in the courts of England and Wales.

15. Entire Agreement

These Terms constitute the entire agreement between you and us relating to the beta Platform and supersede any prior discussions or understandings.
